Unite said the move can negatively affect the morale of the remaining HP workforce, who would be forced to work under the constant threat of job loss in the near future. <p class="MsoNormal">HM Revenue &amp; Customs (HMRC) investigators found that Benjamin Gains, a proprietor was paying less than minimum wages to his employees. Operating as an optician under the name of BG Optical, Gains had employed four employees whom he paid almost 40% less than the National Minimum Wage (NMW). </p>

<p class="MsoNormal">He was also found guilty of drawing up false contracts to prove to the HM Revenue &amp; Customs (HMRC) that he had not violated any rules. He was ordered to pay a fine of &#163;3,696. This was a historic landmark in <st1:city w:st="on"><st1:place w:st="on">Manchester</st1:place></st1:city> as the first case brought to prosecution under the National Minimum Wage offences.<span style="">  </span></p>

<p class="MsoNormal">The optician Gains operated two premises in <st1:place w:st="on">Liverpool</st1:place> and provided his employers with annual contracts that offered salaries close to the minimum wage. When the HMRC investigators observed it and pointed out, Gains attempted to backdate the contracts and produce another set of falsified documents to prove that he was not guilty. In fact, he had altered the working hours and the section on meal breaks to make the contract genuine under the law. </p>

The company pleaded guilty to infringing Regulation 16 of the Quarries Regulations 1999 at <st1:street w:st="on"><st1:address w:st="on">Cardiff Crown Court</st1:address></st1:street>. </p>
